1. Acceptance of Terms

By accessing and using SubTasks ("the Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

SubTasks is operated by Tony Howell, a sole proprietor based in Texas, United States.

2. Description of Service

SubTasks is an adult relationship management platform designed only for consenting adults who choose to practice consensual power-exchange dynamics (sometimes called Dominant/submissive or D/s). The Service allows partners to create and assign tasks, track compliance through points, demerits, punishments, and rewards, exchange messages and notes, and optionally submit photo proof of task completion.

The Service is intended to help consenting adult partners document expectations, accountability structures, rewards, consequences, and communication around a dynamic they have chosen together. It is not a tool for controlling, monitoring, threatening, coercing, exploiting, or abusing another person. SubTasks does not create authority over another person and does not replace ongoing communication, negotiation, safety planning, or the right of any participant to withdraw consent.

By using the Service, you acknowledge that it stores data about intimate relationship dynamics and that you consent to the processing of this sensitive information as described in our Privacy Policy.

3. Eligibility

To use the Service, you must:

  • Be at least 18 years old and old enough to enter a binding contract in your jurisdiction. By creating an account, you confirm that you are an adult. Misrepresentation of your age is grounds for immediate account termination
  • Register with a valid email address
  • Maintain the security of your email account, which is used for authentication via magic links. You are responsible for all activity on your account, including any access gained through your email
  • Use the Service only for consensual adult relationship dynamics and only with partners who are adults and have given their informed, voluntary consent to participate
  • Stop using the Service in connection with any partner who withdraws consent, ends the relevant dynamic, or asks you not to create or maintain tasks, rewards, punishments, notes, or other content about them

If you invite or connect with another person through the Service, you represent that the person is an adult and has knowingly and voluntarily agreed to use the Service with you.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose
  • Use the Service with or concerning anyone under 18
  • Use the Service to facilitate actual abuse, coercion, stalking, trafficking, exploitation, or non-consensual activity
  • Use the Service to pressure, blackmail, threaten, punish, or retaliate against any person for declining, pausing, changing, or withdrawing consent
  • Create tasks, rewards, punishments, notes, messages, or other content that instructs or encourages illegal conduct, self-harm, non-consensual exposure, or harm to another person
  • Harass, threaten, or harm other users
  • Upload content depicting minors, sexual content involving minors, non-consensual intimate images, or intimate content you do not have permission to share
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the Service
  • Scrape, crawl, or bulk-download data from the Service
  • Use the Service to distribute malware or spam

5. User Content and License

You retain ownership of all content you create on the Service. By submitting content, you grant SubTasks a non-exclusive, worldwide, royalty-free license to host, store, encrypt, display, and transmit that content solely for the purpose of operating the Service.

If you publish a Task Kit, you additionally grant SubTasks a license to distribute the kit's content (name, description, designer note, and templates) to other SubTasks users. This distribution license ends when you unpublish or delete the kit.

All licenses granted to SubTasks terminate when you delete your account, except as required for backup retention (see our Privacy Policy).

You represent that you own or have the necessary rights and consents for any content you submit, and that your content does not violate any third party's intellectual property, privacy, publicity, consent, or other rights.

We reserve the right to remove any content that violates these terms.

6. Subscriptions and Payments

SubTasks offers a free tier and a paid Pro subscription. Pro subscriptions are purchased as in-app purchases through Apple's App Store or Google Play Store.

  • Subscription pricing is displayed in the app before purchase
  • Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period
  • You can cancel your subscription through your Apple or Google account settings
  • Refunds are handled by Apple or Google according to their respective refund policies
  • SubTasks does not directly process or store payment card information

If your subscription expires or is cancelled, your account reverts to the free tier. You will not lose any data, but access to Pro features will be restricted.

7. Termination

By you: You may delete your account at any time at subtasksapp.com/delete-account. See our Privacy Policy for details on what happens to your data.

By us, for cause: We may suspend or terminate your account immediately if you violate these terms, engage in illegal activity, disregard another person's withdrawal of consent, or if we reasonably believe your use of the Service poses a safety risk.

By us, without cause: We may discontinue the Service or terminate accounts for any other reason with at least 30 days' notice via email. During that notice period, you may export your data.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, SubTasks shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service, including but not limited to damages for loss of data, emotional distress, or reputational harm.

Our total aggregate liability for any claims arising from or relating to the Service shall not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) one hundred US dollars ($100).

You acknowledge that the Service stores sensitive information about intimate relationship dynamics. While we implement strong security measures (described in our Privacy Policy), no system is perfectly secure, and you accept the residual risk of using a digital service for this purpose.

You are solely responsible for the legality, consent, safety, and real-world effects of the dynamics, tasks, rewards, punishments, agreements, messages, and other content you create or follow through the Service. SubTasks does not supervise, verify, enforce, or mediate consent between users and is not responsible for harm arising from offline conduct or from relationship decisions made by users.

10. Indemnification

You agree to indemnify and hold harmless SubTasks and its operator from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: (a) your use of the Service, (b) your violation of these terms, (c) your content, or (d) your violation of any third party's rights.

11. Dispute Resolution

Informal resolution first: Before filing any formal proceeding, you agree to contact us at hello@subtasksapp.com and attempt to resolve the dispute informally for at least 30 days.

Arbitration: If informal resolution fails, any dispute arising from or relating to these terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Arbitration will take place in Texas or, at your election, remotely via video conference.

Class action waiver: You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.

Small claims exception: Either party may bring a claim in small claims court if the claim qualifies.

Opt-out: You may opt out of this arbitration agreement by emailing hello@subtasksapp.com within 30 days of creating your account, with the subject line "Arbitration Opt-Out."

12. Governing Law

These terms are governed by the laws of the State of Texas, United States, without regard to conflict of law principles. This does not limit any consumer protection rights that apply to you under the mandatory laws of your jurisdiction.

13. Changes to Terms

We may update these terms from time to time. For material changes, we will provide at least 30 days' advance notice via email and in-app notification. Continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated terms, you may delete your account before they take effect.
